Auto Accident Victims get Large Settlement

While traveling to Nolin Lake, a family had a serious accident. Their van rolled over as the driver tried to avoid an accident with a car that pulled in front of them. The driver's paraplegic daughter and her grandmother sustained serious injuries. They rode in the back seat of the van, which collapsed and they were thrown out the back door. The family came to the Becker Law Office to seek justice.

We reviewed the case and prepared to take the van manufacturer to court for the failure of the seat and door. We also prepared a suit against the company that customized the van. Before going to trial, the family's insurance company paid a settlement of $100,000 to the girl and $85,000 to the grandmother. On the eve of the trial, the manufacturer and seat maker settled for a total of $190,000; 70 percent for the girl and 30 percent for the grandmother.

Since the girl receives Social Security and Medicaid benefits for her previously amputated legs, we put her settlement awards in a Special Needs Trust. This kept her qualified for government benefits and covers expenses not met by those payments.
